Yes; the game has obviously been opened; I take it up to the counter and they charge brand new price for it. Like when I bought Legend Of Zelda:Twilight Princess on Nintendo Gamecube, Jaws Unleashed and Family Guy on Xbox and Silent Hill Origins on Playstation 2; they were all open and still had a $49.99 new sticker on them. which I found odd because I thought something could only be considered new if it was never opened; I never shop at Gamestop anymore though; I have been going to Play N Trade for a year and a half now.
